With the following privacy policy, we would like to inform you about which types of your personal data (hereinafter also referred to as "data") we process for which purposes and to what extent. The privacy policy applies to all processing of personal data carried out by us, both in the context of providing our services and, in particular, on our websites, in mobile applications, and within external online presences, such as our social media profiles (hereinafter collectively referred to as "online offer").

Relevant legal bases

Relevant legal bases according to the GDPR: Below you will find an overview of the legal bases of the GDPR on which we process personal data. Please note that, in addition to the regulations of the GDPR, national data protection requirements may apply in your or our country of residence or domicile. Furthermore, should more specific legal bases be relevant in individual cases, we will inform you of these in the privacy policy.

  • Consent (Art. 6 para. 1 sentence 1 lit. a) GDPR) - The data subject has given their consent to the processing of personal data concerning them for one or more specific purposes.
  • Performance of a contract and pre-contractual inquiries (Art. 6 para. 1 sentence 1 lit. b) GDPR) - Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
  • Legal obligation (Art. 6 para. 1 sentence 1 lit. c) GDPR) - Processing is necessary for compliance with a legal obligation to which the controller is subject.
  • Legitimate interests (Art. 6 para. 1 sentence 1 lit. f) GDPR) - processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

National data protection regulations in Germany: In addition to the data protection regulations of the GDPR, national regulations on data protection apply in Germany. These include in particular the Act on Protection against Misuse of Personal Data in Data Processing (Bundesdatenschutzgesetz – BDSG). The BDSG contains in particular special regulations on the right to information, the right to erasure, the right to object, the processing of special categories of personal data, the processing for other purposes and the transmission as well as automated individual decision-making including profiling. Furthermore, state data protection laws of the individual federal states may apply.

Security measures

In accordance with legal requirements, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of processing, as well as the different probabilities of occurrence and the extent of the threat to the rights and freedoms of natural persons, we take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk.

The measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical and electronic access to the data, as well as access, input, disclosure, ensuring availability and separation of the data. Furthermore, we have established procedures that guarantee the exercise of data subject rights, the deletion of data and reactions to data threats. Furthermore, we take the protection of personal data into account as early as the development or selection of hardware, software and procedures in accordance with the principle of data protection, through technology design and through data protection-friendly default settings.

Securing online connections through TLS/SSL encryption technology (HTTPS): To protect the data of users transmitted via our online services from unauthorized access, we rely on TLS/SSL encryption technology. Secure Sockets Layer (SSL) and Transport Layer Security (TLS) are the cornerstones of secure data transmission on the Internet. These technologies encrypt the information transmitted between the website or app and the user's browser (or between two servers), protecting the data from unauthorized access. TLS, as the more advanced and secure version of SSL, ensures that all data transmissions meet the highest security standards. When a website is secured by an SSL/TLS certificate, this is signaled by the display of HTTPS in the URL. This serves as an indicator to users that their data is transmitted securely and encrypted.

International data transfers

Data processing in third countries: If we transfer data to a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or this occurs as part of the use of third-party services or the disclosure or transfer of data to other persons, bodies or companies (which is recognizable from the postal address of the respective provider or if the data transfer to third countries is expressly pointed out in the privacy policy), this always takes place in accordance with the legal requirements.

For data transfers to the USA, we primarily rely on the Data Privacy Framework (DPF), which was recognized as a secure legal framework by an adequacy decision of the EU Commission on July 10, 2023. In addition, we have concluded standard contractual clauses with the respective providers, which comply with the requirements of the EU Commission and lay down contractual obligations for the protection of your data.

This dual protection ensures comprehensive protection of your data: The DPF forms the primary level of protection, while the standard contractual clauses serve as additional security. Should there be any changes within the framework of the DPF, the standard contractual clauses will serve as a reliable fallback option. In this way, we ensure that your data is always adequately protected, even in the event of political or legal changes.

We will inform you about whether the individual service providers are certified according to the DPF and whether standard contractual clauses are available. Further information on the DPF and a list of certified companies can be found on the website of the US Department of Commerce at https://www.dataprivacyframework.gov/.

For data transfers to other third countries, corresponding security measures apply, in particular standard contractual clauses, express consents or legally required transfers. General information on data storage and deletion

We delete personal data that we process in accordance with the statutory provisions as soon as the underlying consents are revoked or there are no further legal bases for the processing. This applies to cases in which the original processing purpose no longer applies or the data is no longer required. Exceptions to this rule exist if legal obligations or special interests require longer storage or archiving of the data.

In particular, data that must be retained for commercial or tax reasons or whose storage is necessary for legal prosecution or for the protection of the rights of other natural or legal persons must be archived accordingly.

Our data protection notices contain additional information on the storage and deletion of data that apply specifically to certain processing processes.

If there are several details regarding the storage period or deletion deadlines of a date, the longest period is always decisive. We process data that is no longer required for the originally intended purpose, but is stored due to legal requirements or other reasons, exclusively for the reasons that justify its storage.

Storage and deletion of data: The following general deadlines apply to storage and archiving under German law:

  • 10 years - Retention period for books and records, annual financial statements, inventories, management reports, opening balance sheet and the work instructions and other organizational documents required for their understanding (§ 147 para. 1 no. 1 in conjunction with para. 3 AO, § 14b para. 1 UStG, § 257 para. 1 no. 1 in conjunction with para. 4 HGB).
  • 8 years - Booking documents, such as invoices and expense receipts (§ 147 para. 1 no. 4 and 4a in conjunction with para. 3 sentence 1 AO and § 257 para. 1 no. 4 in conjunction with para. 4 HGB).
  • 6 years - Other business documents: received commercial or business letters, reproductions of the sent commercial or business letters, other documents, insofar as they are relevant for taxation, e.g. hourly wage slips, operating statements, calculation documents, price tags, but also payroll documents, insofar as they are not already booking documents and cash register receipts (§ 147 para. 1 no. 2, 3, 5 in conjunction with para. 3 AO, § 257 para. 1 no. 2 and 3 in conjunction with para. 4 HGB).
  • 3 years - Data required to consider potential warranty and damage claims or similar contractual claims and rights and to process related inquiries, based on past business experience and customary industry practices, will be stored for the duration of the regular statutory limitation period of three years (§§ 195, 199 BGB).

Start of the period at the end of the year: If a period does not expressly begin on a specific date and is at least one year, it automatically starts at the end of the calendar year in which the event triggering the period occurred. In the case of ongoing contractual relationships in which data is stored, the event triggering the period is the point in time at which the termination becomes effective or other termination of the legal relationship.

Rights of data subjects

Rights of data subjects under the GDPR: As a data subject, you have various rights under the GDPR, which arise in particular from Art. 15 to 21 GDPR:

  • Right to object: You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions. Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
  • Right of revocation for consents: You have the right to revoke consents granted at any time.
  • Right to information: You have the right to request confirmation as to whether data concerning you is being processed and to information about this data as well as to further information and a copy of the data in accordance with the statutory provisions.
  • Right to rectification: You have the right, in accordance with the statutory provisions, to request the completion of data concerning you or the rectification of incorrect data concerning you.
  • Right to erasure and restriction of processing: In accordance with the statutory provisions, you have the right to demand that data concerning you be erased immediately or, alternatively, to demand a restriction of the processing of the data in accordance with the statutory provisions.
  • Right to data portability: You have the right to receive data concerning you that you have provided to us in a structured, commonly used and machine-readable format in accordance with the statutory provisions or to request its transfer to another controller.
  • Complaint to a supervisory authority: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the provisions of the GDPR.

Business services

We process data of our contractual and business partners, e.g. customers and interested parties (collectively referred to as "contractual partners"), within the framework of contractual and comparable legal relationships as well as related measures and with regard to communication with the contractual partners (or pre-contractually), for example to answer inquiries.

We use this data to fulfill our contractual obligations. These include in particular the obligations to provide the agreed services, any update obligations and remedies for warranty and other service disruptions. In addition, we use the data to protect our rights and for the purpose of the administrative tasks associated with these obligations as well as the company organization. We also process the data on the basis of our legitimate interests both in proper and economic business management and in security measures to protect our contractual partners and our business operations from misuse, endangerment of their data, secrets, information and rights (e.g. for the participation of telecommunications, transport and other auxiliary services as well as subcontractors, banks, tax and legal advisors, payment service providers or financial authorities). Within the framework of applicable law, we only pass on the data of contractual partners to third parties to the extent that this is necessary for the aforementioned purposes or for the fulfillment of legal obligations. The contractual partners will be informed about other forms of processing, e.g. for marketing purposes, within the framework of this data protection declaration.

We inform the contractual partners which data is required for the aforementioned purposes before or within the framework of the data collection, e.g. in online forms, by means of special markings (e.g. colors) or symbols (e.g. asterisks or similar), or personally.

We delete the data after the expiry of statutory warranty and comparable obligations, i.e. generally after four years, unless the data is stored in a customer account, e.g. as long as it has to be kept for archiving for legal reasons (e.g. for tax purposes, usually ten years). We delete data that has been disclosed to us by the contractual partner as part of an order in accordance with the requirements and generally after the end of the order.

  • Online shop, order forms, e-commerce and performance of services: We process our customers' data to enable them to select, purchase or order the selected products, goods and related services, as well as their payment and provision, delivery or execution. If it is necessary for the execution of an order, we use service providers, in particular postal, forwarding and shipping companies, to carry out the delivery or execution to our customers. We use the services of banks and payment service providers to process payment transactions. The information required is marked as such in the context of the order or comparable purchase process and includes the information required for delivery or provision and billing as well as contact information in order to be able to hold any consultation; Legal bases: Performance of a contract and pre-contractual requests (Art. 6 para. 1 sentence 1 lit. b) GDPR).

Provision of the online offer and web hosting

We process users' data in order to be able to provide them with our online services. For this purpose, we process the user's IP address, which is necessary to transmit the content and functions of our online services to the user's browser or device.

  • Processed data types: Usage data (e.g., page views and time spent, click paths, usage intensity and frequency, device types and operating systems used, interactions with content and functions); Meta, communication and procedural data (e.g., IP addresses, timestamps, identification numbers, persons involved). Log data (e.g. log files regarding logins or the retrieval of data or access times.).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Provision of our online offer and user-friendliness; Information technology infrastructure (operation and provision of information systems and technical equipment (computers, servers, etc.)). Security measures.
  • Storage and deletion: Deletion in accordance with the information in the "General information on data storage and deletion" section.
  • Legal bases: Legitimate interests (Art. 6 para. 1 sentence 1 lit. f) GDPR).

  • Provision of online offer on rented storage space: For the provision of our online offer, we use storage space, computing capacity and software that we rent or otherwise obtain from a corresponding server provider (also called "web hoster"); Legal bases: Legitimate interests (Art. 6 para. 1 sentence 1 lit. f) GDPR).
  • Collection of access data and log files: Access to our online offer is logged in the form of so-called "server log files". The server log files may include the address and name of the web pages and files accessed, date and time of access, data volumes transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page) and, as a rule, IP addresses and the requesting provider. The server log files can be used for security purposes, e.g. to avoid overloading the servers (especially in the event of abusive attacks, so-called DDoS attacks), and to ensure the utilization of the servers and their stability; Legal bases: Legitimate interests (Art. 6 para. 1 sentence 1 lit. f) GDPR). Deletion of data: Log file information is stored for a maximum of 30 days and then deleted or anonymized. Data whose further retention is required for evidentiary purposes is excluded from deletion until the final clarification of the respective incident.

Use of cookies

The term "cookies" refers to functions that store information on users' devices and read it from them. Cookies can also be used in relation to various concerns, such as for the purposes of functionality, security and convenience of online offers as well as the creation of analyses of visitor flows. We use cookies in accordance with the statutory provisions. For this purpose, we obtain the user's consent in advance, if required. If consent is not necessary, we rely on our legitimate interests. This applies if the storage and reading of information is essential in order to be able to provide expressly requested content and functions. These include, for example, the storage of settings and the ensuring of the functionality and security of our online offer. Consent can be revoked at any time. We provide clear information about their scope and which cookies are used.

Information on data protection legal bases: Whether we process personal data with the help of cookies depends on consent. If consent is given, it serves as the legal basis. Without consent, we rely on our legitimate interests, which are explained above in this section and in the context of the respective services and procedures.

Storage period: With regard to the storage period, the following types of cookies are distinguished:

  • Temporary cookies (also: session or session cookies): Temporary cookies are deleted at the latest after a user leaves an online offer and closes their device (e.g. browser or mobile application).
  • Permanent cookies: Permanent cookies remain stored even after the device is closed. For example, the log-in status can be saved and preferred content can be displayed directly when the user visits a website again. Likewise, the user data collected with the help of cookies can be used for reach measurement. Unless we provide users with explicit information on the type and storage period of cookies (e.g. as part of obtaining consent), they should assume that they are permanent and the storage period can be up to two years.

General information on revocation and objection (opt-out): Users can revoke their given consent at any time and also declare an objection to the processing in accordance with the statutory provisions, also by means of the privacy settings of their browser.

  • Processing of cookie data on the basis of consent: We use a consent management solution in which the user's consent to the use of cookies or to the procedures and providers mentioned in the context of the consent management solution is obtained. This procedure serves to obtain, log, manage and revoke consent, in particular in relation to the use of cookies and comparable technologies that are used to store, read and process information on users' devices. Within the scope of this procedure, the users' consent is obtained for the use of cookies and the associated processing of information, including the specific processing and providers mentioned in the consent management procedure. Users also have the option of managing and revoking their consent. The declarations of consent are stored in order to avoid repeated queries and to be able to provide proof of consent in accordance with the statutory requirements. The storage takes place on the server side and/or in a cookie (so-called opt-in cookie) or by means of comparable technologies in order to be able to assign the consent to a specific user or their device. Unless there is specific information on the providers of consent management services, the following general information applies: The duration of the storage of consent is up to two years. A pseudonymous user identifier is created, which is stored together with the time of consent, the information on the scope of consent (e.g. categories of cookies and/or service providers concerned) and information about the browser, the system and the device used; Legal bases: Consent (Art. 6 para. 1 sentence 1 lit. a) GDPR).

Blogs and publication media

We use blogs or comparable means of online communication and publication (hereinafter "publication medium"). The data of the readers are processed for the purposes of the publication medium only to the extent that it is necessary for its presentation and the communication between authors and readers or for reasons of security. Otherwise, we refer to the information on the processing of visitors to our publication medium within the scope of this data protection information.

  • Comments and posts: When users leave comments or other posts, their IP addresses may be stored on the basis of our legitimate interests. This is for our security in case someone leaves illegal content in comments and posts (insults, prohibited political propaganda, etc.). In this case, we ourselves can be held liable for the comment or post and are therefore interested in the identity of the author.

    Furthermore, we reserve the right, on the basis of our legitimate interests, to process the users' data for the purpose of spam detection.

    On the same legal basis, we reserve the right, in the case of surveys, to store the IP addresses of users for their duration and to use cookies in order to avoid multiple votes.

    The information on the person communicated within the scope of the comments and posts, any contact and website information as well as the content information are stored by us permanently until the user objects; Legal bases: Legitimate interests (Art. 6 para. 1 sentence 1 lit. f) GDPR).

Contact and request management

When contacting us (e.g. by post, contact form, email, telephone or via social media) and within the scope of existing user and business relationships, the data of the requesting persons are processed to the extent that this is necessary to answer the contact requests and any requested measures.

  • Contact form: When you contact us via our contact form, by email or other communication channels, we process the personal data transmitted to us to answer and process the respective request. This usually includes information such as name, contact information and, if applicable, other information that is communicated to us and is necessary for appropriate processing. Presences in social networks (social media)

We maintain online presences within social networks and process user data in this context in order to communicate with the users active there or to offer information about us.

We would like to point out that user data may be processed outside the area of the European Union. This may result in risks for users because, for example, the enforcement of user rights could be made more difficult.

Furthermore, the data of users within social networks are generally processed for market research and advertising purposes. For example, user profiles can be created based on the user's usage behavior and the resulting interests. The latter may in turn be used to place advertisements within and outside the networks that presumably correspond to the interests of the users. Therefore, cookies are generally stored on the users' computers, in which the usage behavior and the interests of the users are stored. In addition, data can also be stored in the user profiles independently of the devices used by the users (in particular if they are members of the respective platforms and are logged in there).

For a detailed presentation of the respective forms of processing and the opt-out options, we refer to the data protection declarations and information provided by the operators of the respective networks.

Also in the case of requests for information and the assertion of data subject rights, we would like to point out that these can be asserted most effectively with the providers. Only the latter have access to the user data and can directly take appropriate measures and provide information. Should you nevertheless require assistance, you can contact us.

  • Facebook pages: Profiles within the Facebook social network - The controller is jointly responsible with Meta Platforms Ireland Limited for the collection and transmission of data from visitors to our Facebook page ("fan page"). This includes in particular information about user behavior (e.g. viewed or interacted content, actions performed) and device information (e.g. IP address, operating system, browser type, language settings, cookie data). Further details can be found in the Facebook data policy: https://www.facebook.com/privacy/policy/. Facebook also uses this data to provide us with statistical evaluations via the "Page Insights" service, which provide information on how people interact with our page and its content. This is based on an agreement with Facebook ("Information on Page Insights": https://www.facebook.com/legal/terms/page_controller_addendum), which regulates, among other things, security measures and the exercise of data subject rights.
